Court grants AstraZeneca temp injunction against Apotex

16 April 2009

On 16 April, the US District Court for the District of New Jersey granted Anglo-Swedish drug major AstraZeneca's request for a temporary  restraining order, barring Canada-headquartered generic drugmaker Apotex  from launching a copy version of AstraZeneca's Pulmicort Respules  (budesonide inhalation suspension) until further order of the court. On  27 April, the court will commence a hearing to determine whether the  injunction should be continued.

On 30 March, the US Food and Drug Administration granted approval for a  generic version of AstraZeneca's product to Apotex. The UK-based firm  then filed suit following Apotex' indication of intent to market a  generic version of Pulmicort Respules in the USA prior to the expiration  of AstraZeneca's patents.
