Teva fails to overturn patent for BMS’ apixaban in Russian market

The Russian Patent and Trademark Office refused to overturn the patent for the anticoagulant apixaban, which is owned by US pharma major Bristol Myers Squibb (NYSE: BMY) on the basis of the claim filed by the Israeli pharmaceutical company Teva Pharmaceutical Industries (NYSE: TEVA), reports The Pharma Letter’s local correspondent.

Teva earlier challenged Russian Patent No 2345993, which regulates a group of inventions including apixaban. The company argued that the development does not meet the requirements for industrial applicability and inventive step. Specifically, the applicant cited the lack of examples of the use of the active ingredient for a number of diseases in the priority application, as well as earlier patent documents, which sparks doubt on the novelty of the invention.
